Question: Explain the scope of the doctrine of acknowledgement in muslim law?
The doctrine of acknowledgement in Muslim law is a rule of substantive law that confers the status of sonship and rights to inherit to a child whose paternity cannot be proved by a valid marriage between his parents. It is also known as 'Ikras'. It is not a rule of evidence or a presumption under the Evidence Act. It is not a way of legitimizing an illegitimate child, but a way of declaring the legitimacy of a child when there is no direct proof of marriage or the exact time of conception or birth. The doctrine of acknowledgement only applies when there is a possibility of a lawful union between the parents and when the father intentionally recognizes the child as his son.
